The justices put on their gardening hats and declared the tomato is a vegetable, at least for purposes of collecting tariffs. Fruit importers challenged the 10 percent tariff on the tomatoes they imported from the West Indies. The court, which had earlier decided beans were not seeds, ruled that tomatoes are raised in gardens and cooked as vegetables and therefore were vegetables subject to tariff.
